These Terms of Service ("Terms") govern your use of TariffMax ("App"), provided by TariffMax LLC ("we," "us," or "our"). By accessing or using the App, you agree to these Terms. If not, do not use the App.
1. Eligibility
You must be 18+ or have legal capacity to agree. Accounts represent your organization if enterprise use.
2. Services
The App provides AI-powered U.S. import duty calculations, HTS classification, policy analysis, reports, and revisions tools using Grok API. Features vary by tier:
- Free: Limited 50 estimate queries per month.
- Enterprise: HTS Classification, Custom integrations, audits.
We may update/add/remove features; no liability for changes.
3. User Accounts
- Registration: Accurate info required; secure your credentials.
- Subscriptions: Via Stripe; auto-renew monthly. Cancel anytime—refunds per policy.
- Termination: We may suspend/terminate for violations (e.g., abuse, non-payment).
4. User Content & Conduct
- Inputs: Your HS queries/descriptions are your responsibility—accurate/compliant.
- Prohibitions: No illegal use, reverse-engineering, or overloading (e.g., >1000 queries/hr free).
- License: You grant us non-exclusive rights to process content for services.
5. Intellectual Property
App, code, and outputs (except user content) are our IP. Limited license for personal/business use; no resale/modification.
6. Third-Party Services
App integrates Grok API (xAI terms apply), USITC data (public domain). We aren't liable for their changes/outages.
7. Disclaimer & Liability
See separate Disclaimer. No warranties; use at risk. Liability limited to fees paid last 12 months. No indirect damages.
8. Indemnification
You indemnify us from claims arising from your use/content.
9. Governing Law
Delaware law; disputes in Wilmington courts.
10. Changes
We may update Terms; continued use = acceptance.
